1. Agreement to Terms
By accessing or using the Home Elites platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "Athlete," or "you") and Home Elites Systems Inc. ("Company," "we," or "us"), governing your use of the website, mobile applications, training protocols, and related services.
- Users must be at least 18 years old or have parental/guardian consent to access the platform
- Registration requires providing accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account credentials
- These Terms may be updated periodically; continued use constitutes acceptance of modifications
2. User Obligations
As a member of the Home Elites ecosystem, you agree to use the Service in compliance with all applicable laws and regulations. You are responsible for all activity that occurs under your account.
- You shall not share, resell, or redistribute any training protocols, nutritional plans, or proprietary content
- You must not reverse-engineer, decompile, or attempt to extract source code from any software provided
- Harassment, abusive behavior, or any form of discrimination toward community members or staff is prohibited
- You agree to consult a qualified medical professional before beginning any physical training program
- Misuse of biometric data features or attempts to manipulate performance metrics will result in account termination
3. Intellectual Property
All content, training methodologies, algorithms, software code, designs, logos, trademarks, and documentation available through the Home Elites platform are the exclusive intellectual property of Home Elites Systems Inc.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access the Service for personal, non-commercial use only. This license does not transfer any ownership rights to you.
- All training protocols are proprietary and protected under international copyright law
- The Home Elites name, logo, and associated branding are registered trademarks
- User-generated content (session logs, feedback) remains your property but grants us a limited license for service improvement
- Fair use provisions apply to brief quotations in non-commercial contexts with proper attribution
4. Limitation of Liability
To the fullest extent permitted by applicable law, Home Elites Systems Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount paid by you to Home Elites in the twelve (12) months preceding the claim.
- Training programs are provided as general fitness guidance and do not constitute medical advice
- We are not responsible for injuries sustained during the execution of any training protocol
- We do not guarantee specific fitness outcomes, weight loss results, or performance improvements
- Service availability is provided on an "as-is" basis without warranties of uninterrupted access
5. Governing Law & Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA).
- Arbitration shall take place in Wilmington, Delaware, or remotely by mutual agreement
- Class action lawsuits and class-wide arbitration are expressly waived
- The prevailing party shall be entitled to recover reasonable attorney's fees and associated costs
- These Terms constitute the entire agreement between you and Home Elites regarding the Service
